Federal Judge Rejects Discrimination Claims in New York Weed License Distribution

Federal Judge Anne M. Nardacci dismissed a December legal challenge to New York State’s marijuana licensing procedure filed by two applicants from California. 

The applicants claimed that the program violates the Dormant Commerce Clause and unjustly discriminates against residents of other states. Variscite New York Four LLC and Variscite New York Five LLC represented the applicants in their claims.

According to Breitbart, Judge Nardacci stressed in her ruling that the public interest in allowing cannabis companies with licenses to operate surpasses the issues brought up by the complaint. 

This decision has far-reaching effects and might open the door for the granting of other licenses across the state of New York.

Judge Nardacci clarified that the Dormant Commerce Clause does not cover the federally illegal cannabis trade, emphasizing that states should refrain from enacting laws that hinder interstate commerce unless specifically directed by Congress.

The judge’s ruling was preceded by Governor Kathy Hochul’s recent description of the state’s cannabis rollout as a “disaster”.

The decision was praised by Letitia James, the Democratic attorney general for New York, as a critical step toward ensuring fair participation in the legal cannabis market, particularly for disproportionately affected groups.

Based on the Union-Sun & Journal, the New York State Department of Health has said that it would step up efforts to stop child vaping, eventually aiming to eradicate it entirely. 

Todd Hood, the Madison County Sheriff, issued a warning against the use of e-cigarettes by minors due to the high concentration of THC, the active component in marijuana, that is present in them.

The THC and CBD content of e-cigarettes and traditional joints differs significantly, according to recent research findings. The latter may contain significantly higher levels of THC and nicotine, which can be harmful to health, especially for young adults and adolescents.

Because there is unidentified about the substance and possible health effects of the medication provided to minors and young people, Sheriff Hood stressed the need for caution.
